SUBSTITUTE TRUSTEE’S NOTICE OF SALE

WHEREAS, by Deed of Trust of record in Book 178, Page 715, in the Register’s Office for Lewis County, Tennessee, dated December 14, 2016 and recorded on December 20, 2016, Angela Helen Hinson, a married person and Shirley Ann Spurgeon, a single person, trustor, conveyed to Vanderbilt Mortgage and Finance, Inc., beneficiary, the hereinafter described real property to secure the payment of a Promissory Note (the “Note”) dated December 14, 2016 and other indebtedness as described in said Deed of Trust; and

WHEREAS, Anthony R. Steele resigned as Trustee under said Deed of Trust; and Philip L. Robertson was appointed as Substitute Trustee pursuant to a certain Appointment of Substitute Trustee of record in Book 211, Page 566, in said Register’s Office for Lewis County, Tennessee; and

WHEREAS, default in the payment of the indebtedness secured by said Deed of Trust has been made; and the entire balance of which having been declared due and payable in accordance with the terms of said Note and Deed of Trust, the owner and holder of said indebtedness, Vanderbilt Mortgage and Finance, Inc., has directed me, the undersigned, Substitute Trustee, to foreclose said Deed of Trust and to advertise and sell the real property in satisfaction of said debt and the cost of foreclosure, in accordance with the terms and provisions of the Note and Deed of Trust.

NOW, THEREFORE, by virtue of the authority vested in me by said Deed of Trust, I will on the 25th day of September, 2020, offer for sale and sell the following described real property— 128 April Lane, Hohenwald, Lewis County, Tennessee, at the Lewis County Courthouse, located in Hohenwald, Tennessee, beginning on or about 1:30 p.m., to the last, highest, and best bidder for cash, in hand, and free from all rights and equities of redemption, homestead, dower, marital share and all other exemptions and other rights of every kind, including the statutory right of redemption, all of which were expressly waived by the terms of said Deed of Trust. This sale is subject to, however, such prior encumbrances and priority tax liens as may appear of record in said Register’s Office.

The property herein to be foreclosed is described as follows:

A certain tract or parcel of land in the 3rd Civil District of Lewis County, Tennessee is further described as follows, to-wit:

The following described lot is bound on the South by Jerri Warren, on the North by GMO Threshold Timber Company and Gene Mercer, on the West by Joshua Gardner, and on the East by John Smith and April Lane.

Beginning at a 1/2 inch rebar found in the South line of GMO Threshold Timber Company (Record Book 109, Page 727) and at the Northwest corner of John Smith (Record Book 50, Page 549), said point being the Northeast corner of this lot; thence with Smith, South 04 degrees 24 minutes 55 seconds West, 215.51 feet to a 1/2 inch rebar set in the North margin and at the approximate end of April Lane; thence with April Lane, South 04 degrees 24 minutes 55 seconds West, 40.00 feet to a 1/2 inch rebar found in the North line of Jerri Warren (Record Book 25, Page 782); thence with Warren the following two (2) calls: North 85 degrees 43 minutes 24 seconds West, 231.61 feet to a 1/2 inch rebar set, North 85 degrees 43 minutes 24 seconds West, 3.00 feet to a point; thence with Joshua Gardner (Record Book 166, Page 509), North 10 degrees 23 minutes 24 seconds West, 206.50 feet to a 1/2 inch rebar found; thence with Gene Mercer (Deed Book VV, Page 377) the following two (2) calls, North 82 degrees 12 minutes 08 seconds East 269.15 feet to a 1/2 inch rebar found, South 84 degrees 24 minutes 40 seconds East. 24.32 feet to the beginning; containing 1.40 acres, more or less.

The above described property is subject to:

1. Existing utility lines and easements.

2. Any rights of way for April lane.

The above description is taken from a survey plat dated October 30, 2015 by Stanley Todd Reese, Tennessee Registered Land Surveyor, Certificate Number 2648. Reese Land Surveying, 112 East Commerce Street, Lewisburg, Tennessee 37091.

Being the same property conveyed to Angela Helen Hinson, a married person and Shirley Ann Spurgeon, a single person as tenants in common with right of survivorship by Special Warranty Deed from Vanderbilt Mortgage and Finance, Inc. of record in Record Book 178, page 712, Register’s Office for Lewis County, Tennessee, dated December 14, 2016 and recorded on December 20, 2016. (Value or consideration shown in aforementioned deed $70,000.00.)

Being also known as 128 April Lane, Hohenwald, Tennessee 38462.

This is improved property with mailing and street addresses of 128 April Lane, Hohenwald, Tennessee 38462.

Pursuant to T.C.A. 47-9-604 this sale shall also include the affixed manufactured home described as one (1) 2006 Clayton Manufactured Home, with a Serial No. of CLA055899TNAB.

The sale will be for cash without warranty of any kind including the location, condition or set back of improvements on the property. Undersigned reserves the right to sell the property in individual parcels and / or in a group, in the sole discretion of Undersigned. The property is subject to any unpaid taxes and assessments, any and all restrictive covenants or easements of record with the Register’s Office, Lewis County, Tennessee, and any and all other liens having priority over the Deed of Trust. The proceeds of the sale will be applied in accordance with the provisions of the Deed of Trust. If the highest bidder is unable to comply with the terms of sale, undersigned reserves the right to sell the property to the next highest bidder able to comply or to readvertise the sale if he chooses. Undersigned reserves the right to postpone the date and time of sale upon announcement at the time and place specified above.

NOTICE TO CREDITORS

Case number 2020-PR-40. Estate of Glen Everett Ammons, deceased.

Notice is hereby given that on the 2nd day of September, 2020, Letters of Administration in respect of the estate of Glen Everett Ammons, who died on August 7, 2020, were issued to the undersigned by the Chancery Court of Lewis County, Tennessee. All persons, resident and non-resident, having claims, matured or unmatured, against the estate are required to file the same with the clerk of the above-named court on or before the earlier of the dates prescribed in (1) or (2), otherwise their claims will be forever barred.

(1) (A) Four (4) months from the date of the first publication of this notice if the creditor received an actual copy of this Notice to Creditors at least sixty (60) days before the date that is four (4) months from the date of the first publication; or

(B) Sixty (60) days from the date the creditor received an actual copy of the Notice to Creditors if the creditor received the copy of the notice less than sixty (60) days prior to the date that is four (4) months from the date of the first publication as described in (1)(A); or

(2) Twelve (12) months from the decedent’s date of death.

Case number 2020-PR-39. Estate of Alex Watson Tuttle, deceased.

Notice is hereby given that on the 31st day of August, 2020, Letters of Administration in respect of the estate of Alex Watson Tuttle, who died on July 25, 2020, were issued to the undersigned by the Lewis County Chancery Court of Lewis County, Tennessee. All persons, resident and non-resident, having claims, matured or unmatured, against the estate are required to file the same with the clerk of the above-named court on or before the earlier of the dates prescribed in (1) or (2), otherwise their claims will be forever barred.
