NOTICE OF SALE OF REAL ESTATE

WHEREAS, on January 23, 2017, by deed of trust recorded in the Register’s Office of Lewis County, Tennessee, in Record Book 179 at page 833, ROLCT, William Anthony Turner, conveyed to W. Andrew Yarbrough, Trustee, the hereinafter described real estate to secure the payment of a note; and

WHEREAS, by instrument dated November 9, 2020, of record in Record Book 222 at page 600, ROLCT, the holder and owner of said note appointed Jack B. D. Heath as substitute trustee; and

WHEREAS, default has been made in the payment of said indebtedness and Peoples Bank, the owner and holder of said indebtedness, has declared the entire amount due and payable as provided in said deed of trust, and the trustee has been directed to foreclose on same in accordance with the terms thereof; and

WHEREAS, pursuant to T.C.A. 35-5-101, the owner and holder of said indebtedness has given lawful notice to the debtor of the Lender’s right to foreclose prior to the publication of this Notice of Sale of Real Estate.


WHEREAS, pursuant to T.C.A. 35-5-104, other parties that may have an interest in the tract herein described are the following:

1. Lewis County, Tennessee (county taxes)

2. Heirs of William Anthony Turner.

NOW THEREFORE, the public is hereby notified that the undersigned trustee will sell the hereinafter-described real estate at public auction, to the highest and best bidder, for cash in hand, at the front (East) door of the courthouse in Hohenwald, Lewis County, Tennessee, at 10:00 o’clock a.m. on the 15th day of December, 2020, said property to be sold, free from the equity of redemption, homestead and dower, but subject to unpaid real estate taxes, unpaid solid waste fees, any liens or encumbrances prior to the subject deed of trust, and any priority created by a fixture filing, if any.


The street address of the real estate to be sold is 713 Napier Road, Hohenwald, TN 38462, and said property is located in the Eighth (8th) Civil District of Lewis County, Tennessee, and being more particularly described as follows:

Being Lot No. 4, Section No. 01-North of Quail Hollow Plantation Corporation, as shown on plat of record in Plat Cabinet A, Slide 77, Register’s Office of Lewis County, Tennessee.

Being the same property conveyed to William Turner by deed of Larry Franks, dated April 16, 2001, of record in Record Book 9, page 634, ROLCT.


This property is subject to Declaration of Conditions, Covenants and Restrictions of record in Deed Book A-32, page 608, ROLCT, Deed Book A-33, page 840, ROLCT, and Deed Book A-35, page 150, ROLCT, and as may be further amended.

This property is known as Map 72, Parcel 14.00 in the Tax Assessor’s Office of Lewis County, Tennessee.

The Real Property and improvements thereon, if any, will be sold AS IS WHERE IS without warranties or representations of any kind. The sale held pursuant to this Notice may be rescinded at the trustee’s option at any time. The right is reserved to adjourn the day of the sale to another day, time and place certain without further publication, upon announcement at the time and place for the sale set forth above.

I reserve the right to take or accept the next highest or best bid as such sale should the last and highest bidder fail or refuse to comply with the terms of sale for any reason. In such event, I shall also reserve the right to reopen the bidding or republish and sell said Real Property at my option. The Beneficiary may become the purchaser at the sale. The Trustee reserves the right to conduct the sale by or through his agents or attorneys acting in his place or stead, including the use of an auctioneer.

NOTICE TO CREDITORS

Case number 2020-PR-56. Estate of Donnell Rochelle Smith, deceased.

Notice is hereby given that on the 16th day of November, 2020, Letters Testamentary in respect of the estate of Donnell Rochelle Smith, who died on October 8, 2020, were issued to the undersigned by the Lewis County Chancery Court of Lewis County, Tennessee. All persons, resident and non-resident, having claims, matured or unmatured, against the estate are required to file the same with the clerk of the above-named court on or before the earlier of the dates prescribed in (1) or (2), otherwise their claims will be forever barred.

(1) (A) Four (4) months from the date of the first publication of this notice if the creditor received an actual copy of this Notice to Creditors at least sixty (60) days before the date that is four (4) months from the date of the first publication; or

(B) Sixty (60) days from the date the creditor received an actual copy of the Notice to Creditors if the creditor received the copy of the notice less than sixty (60) days prior to the date that is four (4) months from the date of the first publication as described in (1)(A); or

(2) Twelve (12) months from the decedent’s date of death.

PUBLIC NOTICE

Oliver Fiberglass Products- Showers and Housing Components Plant has applied to the Tennessee Air Pollution Control Division (TAPCD) for renewal of a major source operating permit subject to the provisions of paragraph 1200-03-09-.02(11) of the Tennessee Air Pollution Control Regulations (also frequently referred to as Title V regulations). A major source (Title V) operating permit is required by both the Federal Clean Air Act and the Tennessee Air Pollution Control Regulations.

The applicant is Oliver Fiberglass Products- Showers and Housing Components Plant with a site address of 609 Swan Avenue, Hohenwald, Tennessee 38642. They seek to obtain a major source operating permit for their Fiberglass Products- Showers and Housing Components Manufacturing Operation. However, it should be noted that

this facility has a current Title V operating permit.

The Environmental Protection Agency (EPA) has agreed to treat this draft Part 70 permit as a proposed Part 70 permit renewal and to perform its 45-day review provided by the law concurrently with the public notice period. If any substantive comments are received, EPA’s 45-day review period will cease to be performed concurrently with the public notice period. EPA’s 45-day review period will start once the public notice period has been completed and EPA receives notification from the Tennessee Air Pollution Control Division that comments have been received and resolved. Whether EPA’s 45-day review period is performed concurrently with the public comment period or after the public comment period has ended, the deadline for citizen’s petitions to the EPA Administrator will be determined as if EPA’s 45-day review period is performed after the public comment period has ended (i.e., sequentially).
