SUBSTITUTE TRUSTEE’S SALE

Sale at public auction will be on March 24, 2021 on or about 10:00AM local time, at the East door steps of the Lewis County Courthouse, Hohenwald, Tennessee , conducted by the Substitute Trustee as identified and set forth herein below, pursuant to Deed of Trust executed by DONALD L. MCKINNEY AND JUANA M. MCKINNEY, to Kathy Clark, Trustee, on July 14, 2005, at Record Book 66, Page 774-779 as Instrument No. 17429 in the real property records of Lewis County Register’s Office, Tennessee.

Owner of Debt: U.S. Bank Trust National Association, not in its individual capacity, but solely as trustee of Citigroup Mortgage Loan Trust 2019-A

The following real estate located in Lewis County, Tennessee, will be sold to the highest call bidder subject to all unpaid taxes, prior liens and encumbrances of record:

The following described real property situated in the Fourth (4th) Civil District of Lewis County, Tennessee, and more particularly described as follows:


Beginning at a point in the center of the Mt. Joy Road, which is the northwest corner of the herein described property; thence due south crossing Hunt Branch, a distance of 400 feet to a steel post, being the southwest corner of a tract conveyed to Donald L. McKinney, et ux. by deed of James D. Irwin, et ux. dated July 5, 1983, of record in Deed Book A-24 at Page 198, ROLCT; thence in a southwestwardly direction 216 feet to a beech tree in the southwest corner of the James D. Irwin homeplace; thence south 42 degrees east 200 feet to a tree; thence south 30 degrees east 216 feet to a tree; thence south 18 degrees east 233 feet to an oak tree, north 50 degrees east 417 feet to a hickory tree; thence north 32 degrees east 105 feet to a black walnut tree; thence north 50 degrees east 65 feet to a sycamore tree on the north side of Hunt Branch; thence north 22 degrees east 239 feet to the center of Mt. Joy Road; thence north 50 degrees west up center of said road, a distance of 200 feet; thence north 60 degrees west 364 feet to the point of beginning.


Included within the above described property, but excluded from this conveyance and not conveyed hereby is the following tract or parcel of land conveyed to Donald L. McKinney, et ux. by deed of James D. Irwin, et ux. dated July 5, 1983, of record in Deed Book A-24 at Page 198, ROLCT, which is more particularly described as follows:


Fronting 175 feet on the south side, each corner marked by a steel post of the Mt. Joy Road and extending back in a southwardly direction between parallel lines a distance of 400 feet. Bounded on the south, east and west by James D. Irwin, et ux. and on the north by Mt. Joy Road.

Being the same property conveyed by deed from Juanita H. Irwin, a widow, to Juana M. McKinney, dated August 21, 1987, recorded on August 21, 1987, in Book A-39, Page 767 in Lewis County Records, State of Tennessee.

The street address of the above described property is believed to be 710 Mt Joy Rd, Mt Pleasant, TN 38478, but such address is not part of the legal description of the property sold herein and in the event of any discrepancy, the legal description referenced herein shall control.

SALE IS SUBJECT TO OCCUPANT(S) RIGHTS IN POSSESSION.

THE RIGHT IS RESERVED TO ADJOURN THE DAY OF THE SALE TO ANOTHER DAY, TIME AND PLACE CERTAIN WITHOUT FURTHER PUBLICATION, UPON ANNOUNCEMENT AT THE TIME AND PLACE FOR THE SALE SET FORTH ABOVE. If applicable, the notice requirements of T.C.A. 35-5-101 have been met.

All right of equity of redemption, statutory and otherwise, and homestead are expressly waived in said Deed of Trust, but the undersigned will sell and convey only as Substitute Trustee.

If the U.S. Department of Treasury/IRS, the State of Tennessee Department of Revenue, or the State of Tennessee Department of Labor or Workforce Development are listed as Interested Parties in the advertisement, then the Notice of this foreclosure is being given to them and the Sale will be subject to the applicable governmental entities’ right to redeem the property as required by 26 U.S.C. 7425 and T.C.A. §67-1-1433.

This property is being sold with the express reservation that the sale is subject to confirmation by the lender or trustee. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the purchase price. The Purchaser shall have no further recourse against the Mortgagor, the Mortgagee or the Mortgagee’s attorney.

Case number 2021-PR-6. Estate of Nancy Jane West, deceased.

Notice is hereby given that on the 26th day of February, 2021, Letters of Administration in respect of the estate of Nancy Jane West, who died on 10/23/2020, were issued to the undersigned by the Lewis County Chancery Court of Lewis County, Tennessee. All persons, resident and non-resident, having claims, matured or unmatured, against the estate are required to file the same with the clerk of the above-named court on or before the earlier of the dates prescribed in (1) or (2), otherwise their claims will be forever barred.

(1) (A) Four (4) months from the date of the first publication of this notice if the creditor received an actual copy of this Notice to Creditors at least sixty (60) days before the date that is four (4) months from the date of the first publication; or
