NOTICE OF FORECLOSURE SALE

STATE OF TENNESSEE,

LEWIS COUNTY

WHEREAS, Kenneth Biedenkapp executed a Deed of Trust to Mortgage Electronic Registration Systems, Inc., as beneficiary, as nominee for First Community Mortgage, Inc., Lender and Andrew C. Rambo, Trustee(s), which was dated October 5, 2012, and recorded on October 15, 2012, in Book 142, at Page 491 in Lewis County, Tennessee Register of Deeds.

WHEREAS, default having been made in the payment of the debt(s) and obligation(s) thereby secured by the said Deed of Trust and the current holder of said Deed of Trust, Fifth Third Bank, National Association, (the “Holder”), appointed the undersigned, Brock & Scott, PLLC, as Substitute Trustee, with all the rights, powers and privileges of the original Trustee named in said Deed of Trust; and

NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable as provided in said Deed of Trust by the Holder, and that as agent for the undersigned, Brock & Scott, PLLC, Substitute Trustee, by virtue of the power and authority vested in it, will on December 15, 2021, at 01:00 PM at the usual and customary location at the Lewis County Courthouse, Hohenwald, Tennessee, proceed to sell at public outcry to the highest and best bidder for cash, the following described property situated in Lewis County, Tennessee, to wit:

Beginning at an iron pin found in the west R.O.W. of State Highway 48, said iron pin being in the Southwest corner of Kenneth Carroll as recorded in Record Book 28, Page 140, ROLCT: thence leaving Carroll with said West R.O.W. West 47.65 feet to a steel fence post, said post being the Northeast corner of Roger Pace as recorded in Record Book 63 Page 855, ROLCT, and being in the Southeast corner of the tract being described; thence leaving said west R.O.W. with Pace South 78 deg. 25 min. 47 sec. West 308.95 feet to a steel fence post, South 48 deg. 04 min. 45 sec. West 230.08 feet to an iron pin found, said iron pin being the Northeast corner of Roger Pace as recorded in Deed Book A-27, Page 774, ROLCT, and being a corner of Mary and Jack Labar as recorded in Deed Book A-61, Page 87, ROLCT, and being the Southwest corner of the tract being described; thence leaving Pace with Labar North 28 deg. 30 min. 31 sec. West 380.33 feet to a 14” Hackberry, North 21 deg. 55 min. 53 sec. West 125.61 feet to and 8” Sycamore, said Sycamore being the Northwest corner of the tract being described; thence continuing with Labar North 24 deg. 34 min. 26 sec. East 153.41 feet to a 14” Poplar, North 53 deg. 04 min. 01 sec. East 135.68 feet to an iron pin found, North 19 deg. 14 min. 31 sec. East 125.73 feet to a 6” Hickory, South 82 deg. 08 min. 24 sec. East 19.24 feet to an iron pin found, said iron pin being a corner of Kenneth Carroll as recorded in Record Book 27, Page 857, ROLCT, thence leaving Labar with Carroll and a fence South 28 deg. 25 min. 52 sec. East 10.58 feet to a 4” Sweet Gum, South 72 deg. 04 min. 54 sec. East 92.40 feet to an 8” White Oak, South 65 deg. 18 min. 31 sec. East 62.59 feet to a 16” White Oak, South 55 deg. 55 min. 45 sec. East 144.21 feet to an 8” Popular, South 51 deg. 28 min. 40 sec. East 40.69 feet to a 6” Walnut, South 28 deg. 56 min. 46 sec. East, and passing a 10” Sycamore at 28.31 feet, in all 36.73 feet to a point in the center of Ashton Branch; thence with center of Branch North 69 deg. 57 min. 20 sec. East 101.24 feet to a point, said point being the Northwest corner of Kenneth Carroll (RB 28, PG 140); thence leaving center of Branch with Carroll South 35 deg. 53 min. 29 sec. East, and passing an iron pin found at 38.75 feet in all 303.65 feet to the point of beginning and containing 9.16 acres, more or less, as surveyed by Kenneth Carroll, R.L.S. TN License Number 1335, October 12, 2005.

Being the same property conveyed to Kenneth Biedenkapp by deed from Bobby Joe Sharp and wife, Connie Sharp, dated February 15, 2012 and recorded February 15, 2012 in Record Book 136, page 716, Register’s Office for Lewis County, Tennessee.

The sale of the property described above shall be subject to all matters shown on any recorded plat; any and all liens against said property for unpaid property taxes; any restrictive covenants, easements or set-back lines that may be applicable; any prior liens or encumbrances as well as any priority created by a fixture filing; a deed of trust; and any matter than an accurate survey of the premises might disclose; and

All right and equity of redemption, statutory or otherwise, homestead, and dower are expressly waived in said Deed of Trust, and the title is believed to be good, but the undersigned will sell and convey only as Substitute Trustee. The right is reserved to adjourn the day of the sale to another day, time, and place certain without further publication, upon announcement at the time and place for the sale set forth above.

Case number 2021-PR-56 in the matter of the estate of Oneal Barber, deceased.

Notice is hereby given that on the 9th day of November, 2021, Letters Testamentary in respect of the estate of Oneal Barber, who died on November 2, 2021, were issued to the undersigned by the Lewis County Chancery Court of Lewis County, Tennessee. All persons, resident and non-resident, having claims, matured or unmatured, against the estate are required to file the same with the clerk of the above-named court on or before the earlier of the dates prescribed in (1) or (2), otherwise their claims will be forever barred.

(1) (A) Four (4) months from the date of the first publication of this notice if the creditor received an actual copy of this Notice to Creditors at least sixty (60) days before the date that is four (4) months from the date of the first publication; or

(B) Sixty (60) days from the date the creditor received an actual copy of the Notice to Creditors if the creditor received the copy of the notice less than sixty (60) days prior to the date that is four (4) months from the date of the first publication as described in (1)(A); or

Notice is hereby given that on the 29th day of October, 2021, Letters Testamentary in respect of the estate of Lanny Doyle Brewer, who died on October 8, 2021, were issued to the undersigned by the Lewis County Chancery Court of Lewis County, Tennessee.
